Robert Allen, one of four men charged with capital homicide in the murder of XXXTentacion has filed a petition to be released on bond.

New court documents reveal that the 22-year-old has filed a motion to get a judge to set a bond in his case for a number of reasons. The first being that because he is charged with first-degree murder, he was immediately detained and held without bond.

Allen's lawyer poses a number of examples why his client should be eligible for bond: including that his girlfriend is pregnant with his child. The document also states that Allen would reside with his mother and continue his employment at a local lawn care company.

The document states further that "the proof is not evident nor the presumption great that the defendant committed any crime."

It's unlikely, however, that a judge will be compelled to grant Allen bond or allow him out of jail, considering the circumstances in which he was arrested. Allen fled the state of Florida after X's murder and managed to evade police for a month before he was discovered hiding out at his sister's home in Georgia. He was then extradited to Florida to face the first-degree murder charges, where he is currently residing.

Given that Allen has previously tried to escape law enforcement, it's likely he'll be considered a flight risk. A little over a week ago, Allen pleaded not guilty in the murder of XXXTentacion, born Jahseh Onfroy. Allen is due in court next on Sept. 27.

The enormously popular rapper was shot and killed in his car on June 18 in Deerfield Beach, Fla. All four suspects in his murder, including Allen, have since been arrested by authorities.
